Do I Need Probate to Sell an Inherited Home in BC?

Usually, yes, unless a joint tenant survives, in which case the property typically passes to them directly and probate often isn't needed. Selling an inherited home usually requires a Grant of Probate before the sale can complete, but the home can be listed, and even sold conditionally, before probate comes through.

What If There's No Will?

Family applies for Letters of Administration instead of probate. It's a similar process, with the same 3–6 month timeline.

Can I List Before Probate Is Granted?

Yes. You can list, and even accept an offer, before probate is granted, as long as the contract makes completion conditional on the grant coming through. Have an estate lawyer review the wording first. This means you don't lose months waiting.

What Are the Steps in an Estate Sale?

1. Title search. Confirms who's on title and whether a joint tenant survives.

2. Confirm authority. A named executor applies for a Grant of Probate; if there's no will, family applies for Letters of Administration instead.

3. List the home. This can start before probate is granted, completion is simply made conditional on it.

4. Accept an offer, with the probate condition clearly disclosed.

5. Grant of Probate issued. The executor now has legal authority to complete.

6. Complete the sale. Proceeds go to the estate account for distribution.

Is There Capital Gains Tax on an Inherited House?

The property is deemed sold at fair market value on the date of death. If it was the deceased's principal residence, that gain is usually exempt. Any increase in value after that, up to the sale date, is generally taxable to the estate.
